Client Records & Treatment
It is extremely important for injury victims to maintain good records, or to have someone maintain good records for them in situations where the persons are unable to do so themselves. These records can cover many topics from how the accident occurred, to the medical treatment received to the impact the injuries have on the person’s day to day life.
It can be helpful for an injury victim, and the lawyer, for the injury victim to keep a Journal. During the time immediately after the accident there are normally many entries, with less entries being made as time passes and the injuries stabilize. Obviously, the seriousness of the injuries will dictate in large part how frequent, lengthy and long term the entries are. However it is normal for entries to decrease because after a period of time the recovery may slow and the impact on the day to day life may remain static. There is still pain and effects, but they may be similar to the week before. Injury victims start recording the things that are different or especially difficult , against the backdrop that every day is difficult.
To properly protect yourself, an injury victim should seek immediate and ongoing necessary medical treatment. This should be done for the obvious reason that the medical treatment medically deals with the injuries, but it also is of great legal value in any claim, as it creates a detailed and continuous medical record. When medical reports are requested from doctors, physiotherapists, chiropractors, massage therapists, acupuncturists or other professionals, the quality of the reports will reflect the medical information on file. Ultimately, the better the medical information available on the clients behalf, the better it is for the claim. We are not suggesting padding the file or seeking medical treatment that is unnecessary, but do seek the medical treatment that is needed. We have had cases where we’ve been retained long after the injuries were suffered, and although the person had real pain and real injuries, simply did not seek the medical treatment needed, leaving gaps in the medical evidence, making their claims more difficult than they needed to be. This was unfortunate as it would not have taken much to make the medical information excellent.
This brings us to the important point that a law firm such as Zawislak & Zawislak should be retained as soon after an accident as possible, as we can be of great assistance in explaining the best manner to have the claim unfold. Zawislak & Zawislak, when retained, can also control the information received by the insurance company. Persons who work for insurance companies are looking out for only the insurance companies. We look out for you - they won’t, and we protect you legally, ensuring the insurance companies receive proper information that promotes your claim.
